Terms & Conditions

Please read these Terms and Conditions ("Terms") carefully before engaging OM Technology ("we", "our", "us") for any website development, software development or digital services.

By submitting an enquiry, making payment, or commencing any project with OM Technology, you agree to be bound by these Terms.

1. Services

OM Technology provides website development, e-commerce development, web application development, mobile application development, custom software development and related digital services. The exact scope of services is agreed upon in writing (via WhatsApp, email or formal quotation) before any project commences.

2. Quotations and Pricing

  • All prices displayed on our website are indicative starting prices in Indian Rupees (INR).
  • Final project pricing is confirmed in a written quotation before work begins.
  • Domain registration and web hosting are charged separately unless explicitly included in the quotation.
  • Third-party costs (payment gateway fees, premium plugins, stock images) are the client's responsibility unless included in the scope.
  • Prices are exclusive of GST where applicable.

3. Payment Terms

  • A project advance (typically 50%) is required before development commences. The remaining balance is due before website handover or launch.
  • Payment terms for custom projects will be specified in the individual project agreement.
  • We reserve the right to suspend or withhold project delivery in case of non-payment.
  • All payments are non-refundable once development has commenced, subject to our Refund Policy.

4. Project Scope and Changes

  • The agreed project scope is as specified in the quotation or project brief.
  • Any additions or changes beyond the agreed scope ("change requests") may result in additional charges.
  • Change requests must be submitted in writing (via WhatsApp or email) and approved before implementation.
  • OM Technology will inform you if a requested change falls outside the agreed scope and provide a revised quotation.

5. Client Responsibilities

To ensure timely project delivery, you agree to:

  • Provide all required content (text, images, logo, business information) within agreed timelines.
  • Respond to queries and provide feedback within a reasonable timeframe.
  • Review and approve deliverables in a timely manner.
  • Ensure you have the legal right to use any content, images or trademarks provided to us.
  • Provide accurate business information — we are not responsible for errors arising from incorrect information provided by the client.

6. Delivery Timeline

  • Estimated delivery timelines are provided as guidance and are not guaranteed delivery dates.
  • Timelines commence upon receipt of the project advance payment and all required content.
  • Delays caused by the client's failure to provide content or approvals may extend the delivery timeline.

7. Intellectual Property

  • Upon receipt of full payment, ownership of the developed website or software is transferred to you (the client).
  • OM Technology retains the right to display the completed work in our portfolio, unless you request otherwise in writing.
  • Any third-party components (themes, plugins, frameworks) remain subject to their respective licences.
  • We retain ownership of any proprietary tools, frameworks or components developed independently.

8. Domain and Hosting

  • Domain registration and hosting are the client's responsibility unless explicitly included in the project scope.
  • We can assist with setting up hosting and domain at the client's cost.
  • Annual domain and hosting renewal costs are entirely the client's responsibility.
  • Failure to renew domain or hosting may result in website downtime for which we are not responsible.

9. Warranty and Support

  • We provide a 30-day bug-fix warranty after website launch. This covers defects directly caused by our development work.
  • The warranty does not cover issues caused by third-party services, hosting environment, client modifications or force majeure events.
  • Ongoing maintenance, updates and support beyond the warranty period are available as paid add-on services.

10. Limitation of Liability

To the maximum extent permitted by applicable law, OM Technology shall not be liable for:

  • Indirect, incidental, consequential or punitive damages arising from the use of our services.
  • Loss of revenue, data, business or profits.
  • Issues arising from third-party services (hosting, domain registrars, payment gateways).
  • Downtime caused by hosting providers or internet outages.

Our total liability to you shall not exceed the amount paid by you to OM Technology for the specific project in question.

11. Confidentiality

We treat all business information shared with us as confidential. We will not disclose your business information to third parties without your explicit consent, except as required by law.

12. Termination

Either party may terminate a project by providing written notice. In the event of termination:

  • Work completed to date will be invoiced at a fair rate based on time and resources used.
  • The advance payment may be partially or fully retained to cover work completed.
  • Any deliverables completed and paid for will be transferred to the client.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.

14. Changes to These Terms

We may update these Terms from time to time. The most current version will always be available on our website. Continued engagement with our services after changes constitutes acceptance of the updated Terms.
